Choose Green Terms & Conditions

Preamble

Choose Green (company no 08000878. and registered office at Choose Green, Evegate Business Park, Smeeth, Ashford, Kent - TN25 6SX. Our VAT number is 1329900) is a communication platform whereby upon purchasing a Choose Green loyalty card, customers can receive a discount from participating environmentally friendly retailers and businesses. Outlined below are the terms and conditions upon which Choose Green, and its customers will adhere to.

This page (together with the documents referred to within it) details the terms and conditions on which we supply our service, and how to become a member of Choose Green. Further details can be found on our website www.choosegreen.co.uk. Please read these terms and conditions carefully before ordering a Choose Green loyalty card from our site and becoming a member of Choose Green. By ordering a Choose Green loyalty card, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

We reserve the right to amend these terms and conditions at any time by posting the amended terms and conditions on our site. However, please note that you will be subject to the terms and conditions in force at the time that you ordered a Choose Green loyalty card, unless any change to these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).

Becoming a member of Choose Green

1.1. To join Choose Green, the member (‘you’) must register through the Choose Green website www.choosegreen.co.uk under your proper legal identity.

1.2. You are only eligible to join and continue to take part with the Choose Green initiative if:

i) You are over 18 years of age (if you are an individual)
ii) You are a resident in the UK, Channel Island or Isle of Man address
iii) You provide Choose Green with a valid email address.

1.3. Changes of address and email address must be notified to us.

1.5. Your email address will be used to send you regular Choose Green updates. You will be given the option to opt-out of receiving updates on the sign-up page.

What do you need to know about us?

2.1 We operate our own site. We are Choose Green, a company registered in England and Wales under company number 08000878 and with our registered office at Evegate Business Park, Smeeth, Ashford, Kent - TN25 6SX41. Our VAT number is 1329900. Choose Green will be referred to in these terms and conditions as ‘we’ and ‘us’.

Choose Green and the Customer contract

3.1 After applying for a Choose Green loyalty card, you will receive an e-mail from us acknowledging that we have received your application. Please note that this does not mean that your application has been accepted, but constitutes a request to us to become a member of the initiative. All applications are subject to acceptance by us, and we will confirm such acceptance to you by sending an e-mail that confirms that a Choose Green loyalty card has been dispatched. The contract between Choose Green and the applicant will only be formed when we confirm the application.

Length of Membership

5.1 The Choose Green initiative is an ongoing subscription service. Membership is continuous and is renewed automatically at the end of each membership year. Each membership year runs for 12 calendar months after the date the membership commences.

If you have supplied an email address we will send you an electronic reminder approximately 2 weeks before your annual renewal. This will advise you of the details of the new subscription. If you do not want to renew your membership you should contact us by telephone on +44 (0) 772 661 2120 at any point within your 12 months membership period (and at least 7 days prior to your renewal date) otherwise subscriptions will be automatically renewed. The automatic renewal does not apply to gift purchases.

Delivery of loyalty card 

6.1 You will receive your Choose Green loyalty card and membership documentation within 14 days of our confirmation of your acceptance as a member of the club, unless there are exceptional circumstances.

6.2 You should notify us as soon as possible if your loyalty card is not delivered within this time period so that we can take appropriate action to ensure that one is promptly delivered.

Price and Purchase 

7.1 The price of membership will be as quoted on our site at the time your application is made (except in cases of obvious error.)

7.2 The cost for a replacement Choose Green loyalty card will be £15.

7.3 Prices include VAT.

7.4 Prices are liable to change at any time, but changes will not affect members that have already been accepted and confirmed.

7.5 Payment must be by credit or debit card or by such other method as we may agree. We will charge your credit or debit card when your application for membership is placed. By agreeing to this charge you are confirming that you have sufficient funds in your account to meet the required payment.

8. Participating green businesses and use of your Choose Green loyalty card 

8.1 On presentation of your Choose Green loyalty card, participating businesses will offer an appropriate discount as previously agreed between Choose Green and the business on products and services that are eligible under the Choose Green standards outlined in the environmental policy (link to environmental policy here). These discounts are subject to change and members should check the website or contact us directly to find out what the latest discounts are.

8.2 Offers advertised on our site are only available to Choose Green loyalty card holders who have a login and password. Choose Green members can take advantage of discounts on specific produce in a business premises once a Choose Green loyalty card has been shown. Such offers are not available in conjunction with any other offer run by a business that has signed up.

8.3 The expiry date of each Choose Green loyalty card will vary and will always be checked at each participating business you use. Expired Choose Green cards are not accepted by participating businesses. Choose Green memberships are strictly non-transferable and can only be used by the named member. Any attempted to misuse a Choose Green loyalty card may result in confiscation.

8.4 We will use reasonable endeavours to update our site to show the particulars of participating, environmentally friendly businesses. Participating environmentally friendly businesses may, however, be entitled to withdraw from the initiative or to change the terms and conditions of their availability after you have become a member and we shall have no liability for any such withdrawals or changes in terms and conditions or availability.

8.5 Members will have the benefit of any green businesses which join the club at a later date and any increase in availability of participating businesses.

8.6 Printed marketing material is intended as a guide only and may not include all participating green businesses working with Choose Green at the time of going to print.

9. Printed communication

9.1 Law requires that some of the information or communications we send to you should be in writing, although members should accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, members agree to this and acknowledge that all contracts, notices, information and other communications that we provide electronically comply with any legal requirement. This condition does not affect your statutory rights.

10. Notice of termination 

10.1 You have the right to cancel your initial registration of membership with us within 7 days from your receipt of your membership documentation (cooling off period).

10.2 To cancel your membership, you must inform us in writing.

10.3 If you cancel your membership within the cooling off period, you will be entitled to a refund of your membership, less a pro-rata charge for the period of cover and our £15 administration charge, which is a genuine pre-estimate of the loss we will suffer in the event of a cancellation. Refunds will be subject to return of your Choose Green within 30 days of your cancellation and you will be responsible for the cost of returning your Choose Green card. Subject to any other statutory rights you may have, we do not provide refunds for any cancellations after the expiry of the cooling off period.

10.4 We may give notice to you using either the e-mail or postal address you provided to us in your original membership application, or in any of the ways specified in clause 9. Notice will be effective 24 hours after an e-mail is sent, or three days after the posting date a letter. It may be necessary in the case of a letter, to prove that it was properly addressed, stamped and placed in the post and in the case of an e-mail, that it was sent to the specified e-mail address of The Operations Director.

11. Waiver

11.1 Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on, them.

12. Severability

12.1 If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

13. Our liability

13.1 Subject to clause 13.3, if we fail to comply with these terms and conditions, we shall only be liable for the current membership fee.

13.2 Subject to clause 13.3, we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:

13.2.1 Loss of income or revenue;

13.2.2 Loss of business;

13.2.3 Loss of profits; or

13.2.4 Loss of anticipated savings.

13.3 Nothing in this agreement excludes or limits our liability for:

13.3.1 Death or personal injury caused by our negligence;

13.3.2 Fraud or fraudulent misrepresentation;

13.3.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982

13.3.4 Any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

13.4. We accept no liability for any bad experiences at any of the participating green businesses. We will not become involved in any dispute between you and any business. However please inform us if this occurs.

13.5 We do not give away warranty for any goods or services accessed though, or displayed on, our site.

Consumer rights

14.1 You have the right to cancel your membership with us within 7 days from your receipt of your membership documentation.

14.2 To cancel your membership, you must inform us in writing.

14.3 If you cancel your membership within the 7 day period, you will be entitled to a refund of your membership, less a pro-rata charge for the period of cover and our £15 administration charge. Refunds will be subject to the return of your Choose Green loyalty card within 30 days and you will be responsible for the cost of returning your Choose Green loyalty card. Subject to any other statutory rights you may have, we do not provide refunds for any cancellations after the expiry of the 7 days cooling off period.  

15. Third party rights

15.1 A person who is not party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.

16 Entire agreement 

16.1 These terms and conditions and any document expressly referred to in them constitute the whole agreement between you and us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We each acknowledge that, in entering into these terms and conditions, neither you nor us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them. Nothing in this clause limits or excludes any liability for fraud.

17 Law and jurisdiction 

17.1 This agreement shall be interpreted in accordance with the English law and subject to the non-exclusive jurisdiction of the English Courts.
